WILL of WILLIAM H. HELME (JR.) - 1829


In the Name of God Amen.

I, William H. Helme of the Town of Brookhaven in the County of Suffolk, being of sound and disposing mind and memory do make constitute and publish this my last will and testament.

First, I direct my executors herinafter n... to pay all my just debts and funeral expenses out of my personal estate.

Secondly, I give and bequeath to my dear mother Sarah Helme and my sisters Sarah Maria Robinson and Hannah Woodhull, each the sum of three hundred dollars, to be paid by my executors out of my personal estate, the said legacies to my sisters to be paid to and received and enjoyed by them, as femes sole, nothwithstanding their coverture.

Thirdly, I give, devise and bequeath to my kinsman George S. Phillips and my friends Selah B. Strong and Charles Miller of Brookhaven aforesaid and the survisor and survisors of them and the heirs of such survivor for and during the natural life of my brother Thomas Helme but not subject to impeachment of waste, all my lands and tenements situate in the said Town of Brookhaven (except my real estate in the village of Drown meadow and a small farm formerly belonging to Daniel Saxton) and also all my stock of horses, cattle, hogs and sheep and all my carriages and farming utensils, hay, grain and other provisions on my place where I now reside, In trust nevertheless and to and for the following uses and purposed that is to say, to maintain my said mother for the term of one year after my decease to suffer and permit my said sister Sarah Maria to reside in my dwelling house without paying rent during her natural life and to afford her a comfortable maintainance in pensions during the continuance of this trust and subject to those charges to suffer and permit my said brother Thomas to occupy possess and enjoy the said lands and tenements for the benefit of himself and his family so long as they shall deem it expedient for him so to do and also to use and enjoy the personal estate and effects mentioned in this clause so long as they shall deem it expedient, but if as any time the said trustees for the time being shall deem it advantageous for my said brother and his family, I do hereby authorize and require them to take possession of all the said trust land and effects and to lease or hire out the said land and received the rents, produce and profits hereof and to apply the same at their discretion for the maintaninace and support of my said brother and his family and the eduction of his children and I do hereby authorize and empower the said trustees for the time being to cut and sell or to permit my said brother to cut and sell so much of the wood and timber standings on the said trust lands as they may think proper the proceeds thereof to be applied for the benefit of my said brother and his family and from and after the decease of my said brother Thomas I give and devise all the said lands and tenements herein before devised to trustees, to his son George M. P. Helme .............. should the said George .........

Fourthly,....invest the said trustees and the survivors and survivor of them with all the power and authority requisite to carry into effect all the provisions and directions contained in this and the next precedings clauses, and I direct that neither of them shall be held responsible in damages for a mistake in judgment in performing any of the trusts mentioned in this will.

FifthlyI give and bequeath to my mother my colored boy named Samuel.

SixthlyI do hereby authroise my said trustee, to lease, hire out or rent the land in any of them mentioned in the preceeding fourth clause until they shall deem it expedient to sell the same and to pay the same and to pay the se.... and profits there of to the same persons and in the same manner as directed in the said clauses.

and Lastly I do hereby constitute and appoint the ............ Selah B. Stone and Charles Miller executors of this my last will and testament hereby revoking all other wills by me made.

In witness whereof I have hereunto set my hand and seal this seventeenth day of August in the year one thousand eight hundred and twenty nine.
